By using this website, you signify your acceptance of these terms and conditions of use. For the purposes of these terms and conditions, “Us”, “Our” and “We” refers to nataliejayne.com.au and “You” and “Your” refers to you, the client, visitor, website user or person using our website.

AMENDMENT OF TERMS

Natalie Jayne Photography reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. I will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use my website then I will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and nataliejayne.com.au’s rights and obligations to each other.

LIMITATION OF LIABILITY

It is an essential pre-condition to you using my website that you agree and accept that nataliejayne.com.au is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in my documents or information, any goods or services I may offer or from any other use of the website. This includes your use or reliance on any third party content, links, comments or advertisements. Your use of, or reliance on, any information or materials on this website is entirely at your own risk, for which I shall not be liable.

It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

It is agreed that Natalie Jayne Photography retains copyright to all images taken at your photo session. It is illegal, unethical, punishable by law, to scan, copy or reproduce these images in any manner or medium unless you have purchased a limited copyright licence from Natalie Jayne Photography.

Clients cannot authorise any reproductions of images for commercial use, personal use, for photographic competition or display. The images may be of you or your child, Natalie Jayne Photography owns the copyright to the images. Natalie Jayne Photography is the only entity who can crop, alter or modify any image produced at your session.

All files remain the property of Natalie Jayne Photography. It is agreed that Natalie Jayne Photography may use any image from the photo session for industry competitions and as required for reasonable general promotional material, including social media.

While the digital files are available for purchase, copyright is retained by Natalie Jayne Photography and a limited release (for personal use only) is given for the files when they are purchased.

A limited release means you are able to use your images for any purpose other than 1) sell them to a 3rd party 2) enter them into competitions 3) use them for commercial purposes 4) edit the image in any way.

Images are not to be used for commercial use.

SESSION AND BOOKING FEE

Sessions are booked by payment of the non-refundable session/starter fee which includes the session itself and an up-to- 5”x7″ art print of your choice.
The payment of our booking and session fee is to reserve your allocated shoot date, time and current fees.

Your session fee does not include any prints, products or digital files.

The booking is confirmed on receipt of the session / booking fee.

If you, your child or any attending individual is feeling unwell, please call to reschedule. We understand that sometimes, this happens. If you must cancel, please try to do so at least 48 hours prior to your session, in the case of not showing up for your session, you forfeit your entire booking/session fee/gift card. The booking and session fee is non-refundable but is transferrable for another date/time as agreed.

GIFT CARDS & GIFT CERTIFICATES

If you have received a gift card from one of our partnered businesses or an online competition, your booking/session fee as this is covered by your certificate. Although to lock in your date an refundable booking fee of $100 is required at time of booking

However if you cancel or change your shoot date without 48 hours notice, your booking fee will be forfeited. If you need to change the date of your photography session, and more than 48 hours notice is given, reschedule is possible providing the date you require is available. If you just disappear and don’t communicate with us after booking a session, you forfeit your gift card.

Gift vouchers / certificates are not exchangeable for cash. They are not transferable to any other person, Valid until date of expiry on the voucher. One gift certificate, per family, per year. Gift certificates received from competitions and special promotions are not included in the total spend for any discounts and collections, such as amount purchased for complimentary digital files.

PHOTOGRAPHY SESSION

Attendance at your photo session is limited to those individuals being photographed. PLEASE discuss with Natalie Jayne Photography if you wish to have extra people attending the session. For newborn and milestone sessions that are held in the studio, attendance is limited to 2 parents only. Siblings are welcome if they are to be photographed as well. If siblings attend a newborn, milestone session, a 2nd adult is required to supervise and take the child after the family group sessions have been completed. In order to minimise distractions and ensure a more productive and successful session it is recommended that the number of persons present be kept to an absolute minimum.

PURCHASING APPOINTMENTS

Your design and ordering appointment will be scheduled at an agreed dated and time, no longer than 3 weeks from your photography session to redeem your gift voucher benefits.

For special offers/discounts and gift vouchers won from a completion, these will be forfeited if decisions can not be made on orders at the initial purchasing appointment.

PAYMENT

Full payment of your order is due at time of ordering at your Design and Purchasing Appointment. Payment can be made by cash, direct deposit or credit card. Production of order of products will not begin until full payment has been made.

Interest free payment plans are available via PAYRIGHT, with a minimum 10% deposit and a 6 month payment term.

Please choose your images carefully. All orders are considered final and cannot be changed or refunded. Please allow up to 4 weeks for completion of your order. Our team will contact you when your order is ready. All digital images supplied with your print orders will be sized the same as your print size.

Depending on your purchase order, your orders will be ready for collection approximately 4 - 6 weeks after order. I will contact you to arrange a pick up time convenient to you.

DIGITAL FILES

Digital files are delivered up to 4 days after your selection. These are delivered via a on-line gallery with a secure login. Please be aware there are inherent risks associated with downloading any software and digital files. Should you have any technical problems downloading any of the files, please contact us so we may try to assist you.

Please ensure you BACKUP YOUR DIGITAL FILES. If you loose your digital files, costs will be associated with any retrieval of digital files after the gallery has expired.
